AGREEMENT TO TERMS
Her Authenticity, LLC (“Her Authenticity”, “we,” “us” or “our”) guides and supports women in discovering their true purpose and designing authentic roadmaps to intentional and fulfilling lives aligned with their unique God-given calling. With guidance, faith-infused personalized strategies, and essential tools, we are committed to guiding women on transformative journeys of self-discovery, fostering personal growth, and empowering them to make meaningful contributions to the world. These Terms of Use (“Terms”) govern your access or use, from within the United States and its territories and possessions, of the website as well as any other media form, media channel, mobile website, or mobile application related, linked or otherwise connected thereto (Collectively, the “Sites”). In these Terms, the words “including” and "include” mean “including, but not limited to.”
These Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity, (“you”), and Her Authenticity. You agree that by accessing or using the Sites, you have read, understood, and agreed to be bound by all of these Terms. If you disagree with any part of these Terms then you may not access the Sites.
Supplemental terms and conditions or documents that may be posted on the Sites from time to time are hereby expressly incorporated by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Sites so that you understand which Terms apply. INTELLECTUAL PROPERTY RIGHTS

We reserve the right to terminate your use of our Sites for violating any of the prohibited uses. We may fully cooperate with any law enforcement agency or authorities, or court order requesting or directing disclosure of the identity of anyone suspected of use of the Sites for illegal purposes.

MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Sites at any time or for any reason at our sole discretion without prior notice. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Sites during any downtime or discontinuation of the Sites. Nothing in these Terms will be construed to obligate us to maintain and support the Sites or to supply any corrections, updates, or releases in connection therewith.

BILLING & PAYMENT
You represent and warrant that you have the right to use any credit card or other means of payment that you provide to us. By providing payment card information to us, you authorize us to store and use the card as a payment method for purchases made through your account with us. All billing information you provide to us must be truthful and accurate. Providing any untruthful or inaccurate information is a breach of these Terms and may result in cancellation of your order. Prior to accepting an order, we may also request additional information from you. Verification of information may be required prior to the acknowledgment or completion of any purchase. We reserve the right to refuse or cancel an order for any reason, including but not limited to inaccuracies or errors in service or pricing information, or problems identified by our credit and fraud avoidance department. If your order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will attempt to contact you if all or any portion of your order is canceled or if additional information is required to accept your order. We may request a pre-authorization for some orders placed online with a credit or debit card. This pre-authorization will not be billed to you; however, your card issuer may hold this amount for a short period. Your card issuer determines the length of time the pre-authorization is held. We do this to ensure that the card details are still valid and that you have sufficient funds to complete the transaction.

If you use Apple Pay as a form of payment (when available) for any transaction(s) via our Sites, you acknowledge and agree that all such transactions are between you and us only, not with Apple, and Apple is not responsible for any products or services offered by Libertas. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to our Sites or any products or services we offer. In the event that any such products or services conform to any applicable warranty, you understand and agree that Apple has no responsibility for such failure, that Apple has no warranty obligation whatsoever with respect to our products or services, and that Apple is not responsible for addressing any claims by you or any third party relating to our products or services, including, but not limited to (i) product liability claims; (ii) any claim that our products or services fail to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that your use of any of our products, services, or websites infringes any third party's intellectual property or other rights. You agree to comply with any applicable third-party terms when using our Site or services.

INDEMNITY
You agree to indemnify and hold harmless Her Authenticity and our respective officers, directors, employees and agents from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to (a) your access to or use of our Sites, (b) your User Content or (c) your breach of any of these Terms.

LIMITATIONS OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HER AUTHENTICITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL HER AUTHENTICITY’ AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (US $100.00) OR THE AMOUNTS PAID BY YOU TO Her Authenticity FOR THE PAST THREE MONTHS FOR THE SERVICE.
ARBITRATION
For any dispute you have with Her Authenticity, you agree to first contact us and attempt to resolve the dispute with us informally. If we need to contact you, we will do so at the email address associated with your account. If a dispute arises from or relates to these Terms or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND HER AUTHENTICITY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. To the extent any claim, dispute, or controversy regarding Her Authenticity or our Sites isn’t arbitrable under applicable laws or otherwise: you and Her Authenticity both agree that any claim or dispute regarding Her Authenticity will be resolved exclusively.

USER DATA
We will maintain certain data that you transmit to the Sites for the purpose of managing the performance of the Sites, as well as data relating to your use of the Sites. Although we perform regular routine backups of data, you are solely responsible for all the data that you transmit or that relates to any activity you have undertaken using the Sites. You agree that we shall have no liability to you for any loss or corruption of any such data and you hereby waive any right of action against us arising from any such loss or corruption of such data.
ELECTRONIC SIGNATURES
You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed by the Sites. You hereby waive any rights or requirements under any statutes, regulations, rules, or ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.
